Amelia Island Company awarded $2.18 million dollar damage claim following arbitration. Following a nearly four year battle between local industry giants, The Auchter Company and Amelia Island Company, concerning damage caused by the alleged failure of The Auchter Company to properly install concrete roof tiles at the Amelia Island Inn & Conference Center, the arbitrator has found in favor of Amelia Island Company. Design build contractor not at fault following three week federal trial. Bachara Construction Law Group defended Summit Smith, Inc. and its affiliated entities in a suit brought by Baker County Medical Center for the alleged negligent design, construction and manufacturer of the HVAC system that was designed and installed by Summit and its subcontractors at the Baker County Medical facility. Following two years of discovery, the parties attempted to resolve the case without success. The Plaintiff was confident that it could prove not only liability but also significant damages and success on its ability to obtain a completely different type of HVAC system based on the theory that the system that was installed was an inappropriate design for use in Florida.

Following a three week bench trial in Federal Court in the Middle District of Florida, the Court determined that Summit Smith and its related entities were not liable and that in fact there was nothing wrong with either the design or the system itself. Julie Sears to join Bachara Construction Law Group. Julie Ginden Sears will return to the active practice of law following a seven year hiatus where she devoted all of her efforts to raising her three daughters. Julie’s past experience in construction disputes as well as her past experience in interpreting insurance policies provided an excellent fit with Bachara Construction Law Group. Julie’s initial focus will be advising and handling insurance coverage disputes involving construction defect claims.

Julie and Chip Bachara practiced together at Baumer, Bradford & Walters from 1993 through 1999. Not long after Julie left Baumer, Bradford & Walters, the firm merged with Smith, Gambrell & Russell. For a link to some of the published decisions tried, briefed and/or argued by Julie, click here.
